HB 2439 Becomes Law

HB 2439 became Illinois Public Act 96-0278 on August 11, 2009. The Act amends the Illinois Radon Awareness Act. Changes a provision on the Disclosure of Information on Radon Hazards form. Requires sellers of certain property to disclose, among other things, either (i) that they have no knowledge of elevated radon concentrations or (ii) that prior elevated radon concentrations have been mitigated or remediated (now, only (i) must be disclosed). Provides that the Act's provisions do not apply to the transfer of any residential dwelling unit located on the third story or higher above ground level of any structure or building. Effective immediately.

HB4789 out of Environment & Energy Committee

Illinois HB4789 has been amended in committee to create a new law and has been voted out of the Environment and Energy Committee. The amendment reads as follows:

"Deletes everything after the enacting clause. Creates the Radon-Resistant Residences Act. Creates the Radon-Resistant Building Codes Task Force for the purpose of making recommendations to the Governor, the Illinois Emergency Management Agency, the Environmental Protection Agency, and the Pollution Control Board concerning the adoption of rules for building codes.
Requires the Governor, in coordination with the Agency, the Environmental Protection Agency, and the Pollution Control Board, to propose rules to the General Assembly for radon control for all new residential buildings in the State. Requires that these rules incorporate the radon control methods set forth in the International Residential Code. Effective immediately"

The amended bill is currently on the House calendar for second reading.

It Will Be Law Effective January 1, 2008

Following is the email released today by Peter Hendrick, AARST Executive Director.

Illinois House Bill 1425 was signed into law today by Illinois Governor Rod R. Blagojevich.

This law, which will go into effect January 1, 2008, has key provisions to increase risk reduction that require notifying buyers about radon risk at the time of signing a purchase and sale agreement.

This law was passed through the hard work of many stakeholders, including an on-going dialogue with the real estate sector, as well as the dedication of consumer advocate Gloria Linnertz, the Illinois Home Inspectors Association’s Executive Director John Dunn, and the mid-West chapter of AARST, and the American Lung Association, among others.

Instrumental in the bill’s passage, was the ability of Illinois’ state radon program to provide solid factual data (on a county by county basis) to state policy makers on the dangers and risks of radon exposure to Illinois homeowners.

It is hoped that this legislation will become a model for other states to follow to achieve higher rates of radon risk reduction.
