Illinois Residential Building Code Radon

Thank you Representative Emily McAsey for introducing HB4665. The bill amends the Illinois Residential Building Code Act. Provides that a contract to build a home must contain, in addition to the adoption of a referenced building code, a provision requiring that a radon mitigation system be included in the construction. Effective immediately.

I understand that this would only apply where there is not currently not a municipal building code.

Day Care Act - Radon Testing

HB4606 was introduced by Representative Karen May on February 1, 2012 and has been assigned to the Environmental Health Committee.

The synopsis of the bill reads as follows:

Amends the Child Care Act of 1969. Provides that effective January 1, 2013, licensed day care centers, licensed day care homes, and licensed group day care homes shall have the facility tested for radon at least once every 3 years. Provides that effective January 1, 2014, as part of an initial application or application for renewal of a license for day care centers, day care homes, and group day care homes, the Illinois Department of Children and Family Services shall require proof the facility has been tested within the last 3 years for radon. Provides that the report of the most current radon measurement shall be posted in the facility next to the license issued by the Department. Effective January 1, 2013.

AN ACT concerning civil law.

Be it enacted by the People of the State of Illinois,
represented in the General Assembly:

Section 5. The Illinois Radon Awareness Act is amended by
changing Section 15 and by adding Section 25 as follows:

(420 ILCS 46/15)
Sec. 15. Applicability. This Act shall only apply only to
leased properties to the extent specified in Section 25 of this
Act and to transfers by sale of residential real property.

Sec. 25. Disclosure of Radon hazard to current and
prospective tenants.
(a) A lessor of a dwelling unit shall disclose to lessees
the existence of a radon hazard consistent with the provisions
of this Section. For the purposes of this Section, "dwelling
unit" means a room or suite of rooms used for human habitation
and for which a lessor and a lessee have a written lease
agreement.
(b) The provisions of this Section apply only to dwelling
units located below the third story above ground level.
(c) If a current lessee has provided in writing to the

lessor the results of a radon test that indicate that a radon
hazard exists in a dwelling unit covered by this Section, then
the lessor shall disclose in writing to any individual seeking
to enter into a lease of that dwelling unit that a radon test
has indicated that a radon hazard may exist in the dwelling
unit. After receiving a notification of a radon test that
indicates a radon hazard, the lessor may choose to conduct a
radon test in the dwelling unit. If the lessor's radon test
indicates that a radon hazard does not exist on the premises,
the lessor shall not be required to disclose that a radon
hazard exists in the dwelling unit.
(d) If a lessor conducts a radon test in a dwelling unit
and the radon test indicates that a radon hazard exists in the
dwelling unit, the lessor shall disclose in writing to the
current lessee, and any individual seeking to enter into a
lease of that dwelling unit, the existence of a radon hazard in
the dwelling unit.
(e) If a lessor has undertaken mitigation activities and a
subsequent radon test indicates that a radon hazard does not
exist in the dwelling unit, then the lessor is not required to
provide the disclosure required by this Section.
(f) Nothing in this Section shall be construed to require a
lessor to conduct radon testing.

Section 99. Effective date. This Act takes effect January
1, 2012.

Illinois Senate Passes HB 0141

HB0141 the Tenants Radon Protection has now passed both the House and the Senate. We will now await the Governor’s signature.

The bill passed both the House and Senate unanimously.

The bill provides that if a lessee notifies a lessor that a radon test indicates the existence of a radon hazard in the leased dwelling unit, then the lessor must disclose that risk to any prospective lessee of that unit, unless a subsequent test by the lessor indicates that a radon hazard does not exist in that unit. Further provides that if a test by the lessor indicates the existence of a radon hazard in a dwelling unit, then the lessor must notify current and prospective tenants of that unit. Provides that these requirements do not apply: (i) if the dwelling unit is located on the third or higher story of a building or (ii) if the lessor has undertaken mitigation activities and a subsequent test indicates that a radon hazard does not exist. Effective January 1, 2012.

Representative Dan Reitz has reintroduced the Tenants Radon Protection bill. The bill number is HB0141. Updates will be posted as the bill progresses through the process.

The synopsis of the bill reads as follows:

Creates the Tenants Radon Protection Act. Provides definitions and makes findings. Provides that before a lease is signed, a landlord shall provide to each tenant in a dwelling unit, on or below the third floor, any records or reports pertaining to radon concentrations within the dwelling unit that present a radon hazard. Provides that before a lease is signed, a landlord shall furnish each prospective tenant with an Illinois Emergency Management Agency radon guide for tenants, a prescribed form of disclosure of information on radon hazards, and any test results. Provides that a landlord has up to 30 days to obtain a radon test after receipt of a tenant's notification of a test revealing radon. Provides that a measurement by a radon contractor is valid for 5 years. Provides that nothing implies an obligation on a landlord or a tenant to conduct any radon testing. Provides that this is a limitation on home rule powers. Contains other provisions. Effective January 1, 2012.

HB 5224 - Tenents Radon Protection - passed the Illinois House as amended by a vote of 074-022-001 on March 26, 2010.

The substance of the amendment is as follows:

Replaces everything after the enacting clause with provisions substantially similar to the bill as introduced except that: the landlord shall provide the tenant with an Illinois Emergency Management Agency radon guide for tenants; adds to the rental property disclosure form a statement that IEMA strongly recommends that rental property be tested and an acknowledgment of the tenant's receipt of the radon guide; a landlord may have 30 days to obtain a radon test after a tenant's notification of a test revealing radon; provides that a measurement by a radon contractor is valid for 5 years; and deletes provisions concerning the termination of a lease. Makes other changes. Effective January 1, 2011.

The bill is scheduled for first reading in the Senate on April 13, 2010.

HB 4223 became law as Public Bill 96-0417 on August 13, 2009. The act provides that it is recommended that every occupied school building of a school district be tested every 5 years for radon. Provides that it is recommended that new schools of a school district be built using radon resistant new construction techniques. Allows a school district to maintain, make available for review, and notify parents and faculty of test results. Requires the district to report radon test results to the State Board of Education. Requires the State Board to prepare a report every 2 years of the results from all schools that have performed tests, to be submitted to the General Assembly and the Governor. Provides that if IEMA exempts an individual from being required to be a licensed radon professional, the individual does not need to be a licensed radon professional in order to perform screening tests. Provides that if the results of a radon screening test are found to be 4.0 pCi/L or above, the school district may hire a licensed radon professional to perform measurements before any mitigation decisions are made. Provides that if radon levels of 4.0 pCi/L or above are found, it is recommended that affected areas be mitigated by a licensed radon mitigation professional with respect to both design and installation. Provides that a screening test may be done with a test kit found in a hardware store, department store, or home improvement store or with a kit ordered through the mail or over the Internet. Requires the kit to be provided by a laboratory licensed in accordance with the Radon Industry Licensing Act.

It prohibits any person from selling a device in Illinois to detect the presence of radon or radon progeny in the indoor atmosphere without prior approval of the device from the Agency. Requires all electronic radon detection devices sold in this State to be calibrated to ensure the accuracy and precision of their measurements of radon and radon progeny. Effective immediately.

The act also further amends the Radon Industry Licensing Act. Creates the Radon-Resistant Building Codes Task Force to make recommendations concerning the adoption of rules for building codes.

There has been some activity with the radon bills which warrents updating.

HB1088 has been amended to create the Task Force on Radon-Resistant Building Codes. The amendment has been referred to the Rules Committee.

HB2287 has been re-referred to the Rules Committee as it was not acted on by the Revenue and Finance Committee. Nothing will probably happen with the effort to create a tax credit for radon testing and mitigation. However, the seed has been planted. Maybe the economy will be better next year and we can try again.

HB3830 has been voted out of the Environment and Energy Committee and is on the calendar for second reading.

HB4223 is currently scheduled for third reading in the house.

2009 Radon Legislation

There are several radon bills that have been introduced in Illinois this year. Some are housekeeping items but there are two bills that I want to make readers aware of.

HB 2287 was introduced by Rep. Dan Reitz February 18, 2009. The bill amends the Illinois Income Tax Act. Authorizes a credit to taxpayers in an amount equal to the expenditures by the taxpayer for radon testing and mitigation during the taxable year. Provides that the credit may not exceed $250 per building per year.
The bill has been assigned to the Revenue and Finance Committee.

HB4223 was introduced by Rep. Karen May on February 27, 2009. The bill was amended today to read as follows.Adds a preamble. Replaces the amendatory provisions with provisions amending the School Code. I have great news to add to the blog. Rep. Karen May has introduced HB4789. The bill was introduced February 6, 2008. The synopsis of the bill reads as follows:

"Amends the Radon Industry Licensing Act. Requires the Illinois Emergency Management Agency, in coordination with the Environmental Protection Agency and the Pollution Control Board, to adopt rules for radon control for all new residential buildings. Requires that these rules incorporate the radon control methods set forth in the International Residential Code. Effective immediately."

It Will Be Law Effective January 1, 2008

Following is the email released today by Peter Hendrick, AARST Executive Director.

Illinois House Bill 1425 was signed into law today by Illinois Governor Rod R. Blagojevich.

This law, which will go into effect January 1, 2008, has key provisions to increase risk reduction that require notifying buyers about radon risk at the time of signing a purchase and sale agreement.

This law was passed through the hard work of many stakeholders, including an on-going dialogue with the real estate sector, as well as the dedication of consumer advocate Gloria Linnertz, the Illinois Home Inspectors Association’s Executive Director John Dunn, and the mid-West chapter of AARST, and the American Lung Association, among others.

Instrumental in the bill’s passage, was the ability of Illinois’ state radon program to provide solid factual data (on a county by county basis) to state policy makers on the dangers and risks of radon exposure to Illinois homeowners.

It is hoped that this legislation will become a model for other states to follow to achieve higher rates of radon risk reduction.

The Illinois House passed both House Bills 1425 and 1660 today. Both bills passed unanimously. HB1425 creates the Illinois Radon Awareness Act and HB1660 designates January as Radon Awareness Month. We now start the process in the Senate.

Proposed Legislation

There currently are two active bills in the Illinois House of Representatives regarding radon.

HB1425 creates the Illinois Radon Awareness Act.
HB 1660 designates January as Radon Awareness Month. Hopefully, this bill will be amended to read Radon Action Month.

Two bills, House Bill 1425, Illinois Radon Awareness Act, and House Bill 1660, Radon Action Month were unanimously voted out of the Environmental Health Committee on March 6, 2007.

Radon is the leading cause of lung cancer in non-smokers. EPA estimates that there are approximately 22,000 radon related deaths per year due to radon induced lung cancer.

Passage of these bills will greatly increase awareness regarding this important public health and safety issue.

Possible Letter To Senator

House Bills 1425 and 1660 are currently under consideration in the House.

House Bill 1425 creates the Illinois Radon Awareness Act.
House Bill 1660 designates January as Radon Awareness Month.

Both of these bills address a serious public health and safety issue in the State of Illinois. In the Western suburbs, approximately 45% of the houses have radon in excess of the 4.0 pCi/L action level.

The amended House Bill 1425 was jointly written by Representative Dan Reitz, the Illinois Association of Realtors and the Illinois Home Inspectors Association. It is currently Co-Sponsored by five additional Representatives with Representative Karen May as Chief Co-Sponsor.

Assuming that these Bills pass out of the House, I am asking that you support and shepherd these Bills through the Senate.
