Provides that  effective January 1, 2013, licensed day care centers, licensed day care  homes, and licensed group day care homes shall have the facility tested  for radon at least once every 3 years. Provides that effective January  1, 2014, as part of an initial application or application for renewal of  a license for day care centers, day care homes, and group day care  homes, the Illinois Department of Children and Family Services shall  require proof the facility has been tested within the last 3 years for  radon. Provides that the report of the most current radon measurement  shall be posted in the facility next to the license issued by the  Department. The Illinois Radon Awareness Act is amended by  &lt;br /&gt;changing Section 15 and by adding Section 25 as follows:&lt;br /&gt;  &lt;br /&gt;    (420 ILCS 46/15)  &lt;br /&gt;    Sec. 15. Applicability. This Act shall only apply only to  &lt;br /&gt;leased properties to the extent specified in Section 25 of this  &lt;br /&gt;Act and to transfers by sale of residential real property.  &lt;br /&gt;(Source: P.A. 95-210, eff. 1-1-08.)&lt;br /&gt;  &lt;br /&gt;    (420 ILCS 46/25 new) &lt;br /&gt;    Sec. 25. Disclosure of Radon hazard to current and  &lt;br /&gt;prospective tenants.  &lt;br /&gt;    (a) A lessor of a dwelling unit shall disclose to lessees  &lt;br /&gt;the existence of a radon hazard consistent with the provisions  &lt;br /&gt;of this Section. For the purposes of this Section, "dwelling  &lt;br /&gt;unit" means a room or suite of rooms used for human habitation  &lt;br /&gt;and for which a lessor and a lessee have a written lease  &lt;br /&gt;agreement. &lt;br /&gt;    (b) The provisions of this Section apply only to dwelling  &lt;br /&gt;units located below the third story above ground level. &lt;br /&gt;    (c) If a current lessee has provided in writing to the  &lt;br /&gt; &lt;br /&gt;lessor the results of a radon test that indicate that a radon  &lt;br /&gt;hazard exists in a dwelling unit covered by this Section, then  &lt;br /&gt;the lessor shall disclose in writing to any individual seeking  &lt;br /&gt;to enter into a lease of that dwelling unit that a radon test  &lt;br /&gt;has indicated that a radon hazard may exist in the dwelling  &lt;br /&gt;unit. After receiving a notification of a radon test that  &lt;br /&gt;indicates a radon hazard, the lessor may choose to conduct a  &lt;br /&gt;radon test in the dwelling unit. If the lessor's radon test  &lt;br /&gt;indicates that a radon hazard does not exist on the premises,  &lt;br /&gt;the lessor shall not be required to disclose that a radon  &lt;br /&gt;hazard exists in the dwelling unit. &lt;br /&gt;    (d) If a lessor conducts a radon test in a dwelling unit  &lt;br /&gt;and the radon test indicates that a radon hazard exists in the  &lt;br /&gt;dwelling unit, the lessor shall disclose in writing to the  &lt;br /&gt;current lessee, and any individual seeking to enter into a  &lt;br /&gt;lease of that dwelling unit, the existence of a radon hazard in  &lt;br /&gt;the dwelling unit. &lt;br /&gt;    (e) If a lessor has undertaken mitigation activities and a  &lt;br /&gt;subsequent radon test indicates that a radon hazard does not  &lt;br /&gt;exist in the dwelling unit, then the lessor is not required to  &lt;br /&gt;provide the disclosure required by this Section. &lt;br /&gt;    (f) Nothing in this Section shall be construed to require a  &lt;br /&gt;lessor to conduct radon testing.&lt;br /&gt;   &lt;br /&gt;    Section 99. Effective date. We will now await the Governor’s signature. &lt;br /&gt;&lt;br /&gt;The bill passed both the House and Senate unanimously. &lt;br /&gt;&lt;br /&gt;The bill provides that if a lessee notifies a lessor that a radon test indicates the existence of a radon hazard in the leased dwelling unit, then the lessor must disclose that risk to any prospective lessee of that unit, unless a subsequent test by the lessor indicates that a radon hazard does not exist in that unit. Further provides that if a test by the lessor indicates the existence of a radon hazard in a dwelling unit, then the lessor must notify current and prospective tenants of that unit. Provides that these requirements do not apply: (i) if the dwelling unit is located on the third or higher story of a building or (ii) if the lessor has undertaken mitigation activities and a subsequent test indicates that a radon hazard does not exist. The bill number is HB0141.  Updates will be posted as the bill progresses through the process.&lt;br /&gt;&lt;br /&gt;The synopsis of the bill reads as follows:&lt;br /&gt;&lt;br /&gt;Creates the Tenants Radon Protection Act. Provides definitions and makes findings. Provides that before a lease is signed, a landlord shall provide to each tenant in a dwelling unit, on or below the third floor, any records or reports pertaining to radon concentrations within the dwelling unit that present a radon hazard. Provides that before a lease is signed, a landlord shall furnish each prospective tenant with an Illinois Emergency Management Agency radon guide for tenants, a prescribed form of disclosure of information on radon hazards, and any test results. Provides that a landlord has up to 30 days to obtain a radon test after receipt of a tenant's notification of a test revealing radon. Provides that a measurement by a radon contractor is valid for 5 years. Provides that nothing implies an obligation on a landlord or a tenant to conduct any radon testing. Provides that this is a limitation on home rule powers. Contains other provisions. The act provides that it is recommended that every occupied school building of a school district be tested every 5 years for radon. Provides that it is recommended that new schools of a school district be built using radon resistant new construction techniques. Allows a school district to maintain, make available for review, and notify parents and faculty of test results. Requires the district to report radon test results to the State Board of Education. Requires the State Board to prepare a report every 2 years of the results from all schools that have performed tests, to be submitted to the General Assembly and the Governor. Provides that if IEMA exempts an individual from being required to be a licensed radon professional, the individual does not need to be a licensed radon professional in order to perform screening tests. Provides that if the results of a radon screening test are found to be 4.0 pCi/L or above, the school district may hire a licensed radon professional to perform measurements before any mitigation decisions are made. Provides that if radon levels of 4.0 pCi/L or above are found, it is recommended that affected areas be mitigated by a licensed radon mitigation professional with respect to both design and installation. Provides that a screening test may be done with a test kit found in a hardware store, department store, or home improvement store or with a kit ordered through the mail or over the Internet. The Act amends the Illinois Radon Awareness Act. Changes a provision on the Disclosure of Information on Radon Hazards form. Requires sellers of certain property to disclose, among other things, either (i) that they have no knowledge of elevated radon concentrations or (ii) that prior elevated radon concentrations have been mitigated or remediated (now, only (i) must be disclosed). Provides that the Act's provisions do not apply to the transfer of any residential dwelling unit located on the third story or higher above ground level of any structure or building. The act Amends the Radon Industry Licensing Act. It prohibits any person from selling a device in Illinois to detect the presence of radon or radon progeny in the indoor atmosphere without prior approval of the device from the Agency. Requires all electronic radon detection devices sold in this State to be calibrated to ensure the accuracy and precision of their measurements of radon and radon progeny. Effective immediately.&lt;br /&gt;&lt;br /&gt;The act also further amends the Radon Industry Licensing Act. Changes a provision on the Disclosure of Information on Radon Hazards form. Requires sellers of certain property to disclose, among other things, either (i) that they have no knowledge of elevated radon concentrations or (ii) that prior elevated radon concentrations have been mitigated or remediated (now, only (i) must be disclosed). Provides that the Act's provisions do not apply to the transfer of any residential dwelling unit located on the third story or higher above ground level of any structure or building. &lt;br /&gt;&lt;br /&gt;House Bill 4223 provides that it is recommended that every occupied school building of a school district be tested every 5 years for radon. Provides that it is recommended that new schools of a school district be built using radon resistant new construction techniques. Allows a school district to maintain, make available for review, and notify parents and faculty of test results. Requires the district to report radon test results to the State Board of Education. Requires the State Board to prepare a report every 2 years of the results from all schools that have performed tests, to be submitted to the General Assembly and the Governor. Provides that if IEMA exempts an individual from being required to be a licensed radon professional, the individual does not need to be a licensed radon professional in order to perform screening tests. Provides that if the results of a radon screening test are found to be 4.0 pCi/L or above, the school district may hire a licensed radon professional to perform measurements before any mitigation decisions are made. Provides that if radon levels of 4.0 pCi/L or above are found, it is recommended that affected areas be mitigated by a licensed radon mitigation professional with respect to both design and installation. Provides that a screening test may be done with a test kit found in a hardware store, department store, or home improvement store or with a kit ordered through the mail or over the Internet. The amendment has been referred to the Rules Committee.&lt;br /&gt;&lt;br /&gt;HB2287 has been re-referred to the Rules Committee as it was not acted on by the Revenue and Finance Committee.  Nothing will probably happen with the effort to create a tax credit for radon testing and mitigation.  However, the seed has been planted. Some are housekeeping items but there are two bills that I want to make readers aware of.&lt;br /&gt;&lt;br /&gt;HB 2287 was introduced by Rep. Dan Reitz February 18, 2009. Requires the Illinois Emergency Management Agency, in coordination with the Environmental Protection Agency and the Pollution Control Board, to adopt rules for radon control for all new residential buildings. Requires that these rules incorporate the radon control methods set forth in the International Residential Code. Effective immediately."&lt;br /&gt;&lt;br /&gt;This is great news.
